The quasi-interchangeability of the words »culture« and »world« in German philosophy of culture at the beginning of the 20th century has frequently been stressed. Can we infer from that the idea that this philosophy of culture could be described as a type of cosmology? This article argues for such an interpretation, reflecting on Georg Simmel's work, particularly his little known concept of »ideal world«. Following this path, Simmel's relation to Kant and the Southwest School of Neo-Kantianism is analyzed.

This monograph proposes a new way of studying the different forms of correlational inference, known in the Islamic jurisprudence as qiyās. According to the authors’ view, qiyās represents an innovative and sophisticated form of dialectical reasoning that not only provides new epistemological insights into legal argumentation in general but also furnishes a fine-grained pattern for parallel reasoning which can be deployed in a wide range of problem-solving contexts and does not seem to reduce to the standard forms of analogical reasoning (...) studied in contemporary philosophy of science and argumentation theory. After an overview of the emergence of qiyās and of the work of al-Shīrāzī penned by Soufi Youcef, the authors discuss al-Shīrāzī’s classification of correlational inferences of the occasioning factor. The second part of the volume deliberates on the system of correlational inferences by indication and resemblance. The third part develops the main theoretical background of the authors’ work, namely, the dialogical approach to Martin-Löf's Constructive Type Theory. The authors present this in a general form and independently of adaptations deployed in parts I and II. Part III also includes an appendix on the relevant notions of Constructive Type Theory, which has been extracted from an overview written by Ansten Klev. The book concludes with some brief remarks on contemporary approaches to analogy in Common and Civil Law and also to parallel reasoning in general. (shrink)

Maqasid al-Shariah based Islamic bioethics is an Islamic bioethics concept which uses the objectives of the Shariah as its approach in analysing and assessing bioethical issues. Analysis based on maqasid al-Shariah based Islamic bioethics will examine any bioethical issues from three main aspects namely intention, method, and output or final goal of the studied issues. Then, the evaluation will be analysed from human interest hierarchy, inclusivity, and degree of certainty. The Islamic bioethics concept is a manifestation of dynamic Islamic jurisprudence (...) which can overcome new complex and complicated bioethical issues such as tri-parent baby technology issues. Therefore, this article will introduce and explain the concept of maqasid al-Shariah based Islamic bioethics and outline a general guidance of maqasid al-Shariah based Islamic bioethics to determine a maqṣad based on standards of human good or well-being and harm. Despite the fact that it has been more than 40 years since Henry Corbin and Hossein Ziai pointed out that the work of Shihāb al-Dīn Suhrawardī (549/1155, 587/1191) has not yet been systematically studied, a thorough investigation of his work is still in its infancy. The present brief study, which aims to contribute to filling such a gap by further developing some of the points contained in Rahman & Seck's (2022) paper, articulates some remarks on the relevance of Suhrawardī's epistemology (...) of presence for contemporary studies on temporal logic. More specifically, we will focus our brief presentation on the fruitfulness of his postulate of the priority of experience of immediate knowledge discussed in the Ḥikmat al-Ishrāq and how this postulate is related to the concept of self-consciousness (وعي الذاتي).Thus the particularity of this study is that Suhrawardī's epistemology of presence, unlike contemporary temporal logic developed for example by Prior, emphasizes the temporalization of the instantiation of an event or the performance of an act rather than of the propositions that express that event or act. Moreover, in Suhrawardī's modal syllogistic, there is an analysis of contingency that differs from most contemporary authors and that also involves several dimensions of time. More generally, Suhrawardī's notion of direct knowledge offers new insights into the logical and ontological status of the now. (shrink)

With the rapid advancements made in biotechnology, bioethical discourse has become increasingly important. Bioethics is a multidisciplinary and interdisciplinary field that goes beyond the realm of natural sciences, and has involved fields in the domain of the social sciences. One of the important areas in bioethical discourse is religion. In a country like Malaysia, where Muslims make up the majority of the population, Islam plays a crucial role in providing the essential guidelines on the permissibility and acceptability of biotechnological applications (...) in various fields such as medicine, agriculture, and food processing. This article looks at the framework of a complementary model of bioethics derived from the perspective of Islam. The framework is based on ‘maqasid al-shariah’ (purposes or objectives of Islamic law) which aims to protect and preserve mankind’s faith, life, intellect, progeny, and property. It is proposed that ‘maqasid al-shariah’ be used as a pragmatic checklist that can be utilized in tackling bioethical issues and dilemmas. (shrink)

One of the epistemological results emerging from this initial study, is that the different forms of co-relational inference, known in the Islamic jurisprudence as qiyās represent an innovative and sophisticated form of reasoning that not only provide new epistemological insights of legal reasoning in general but they also furnish a fine-grained pattern for parallel reasoning that can be deployed in a wide range of problem-solving contexts and that does not seem to reduce to the standard forms of analogical argumentation studied (...) in contemporary philosophy of science. More specifically the main claim is that a dialectical framework provides the right instrument to stress two of the most salient features of this form of inference: (1) it's heuristic nature and (2) the dynamics underlying the meaning-explanation of the terms involved. Both display what we take to be the main epistemological idea behind the qiyās, namely: the open texture of the meaning of normative statements. To put it more generally, the notion of co-relational inference suggests that every form of parallel reasoning based on meaning presupposes that the concept of meaning involved is open to contextual changes. The present study on al-Dīn Suhrawardī's Ḥikmat al-Ishrāq, develops some preliminary explorations on his logic under the background of his remarkable epistemology of pis some witness of d resence. The paper paves the way for responding to the challenges of Tony Street on the compatibility of Suhrawardī's critique of Ibn Sīnā with the development of a temporal and modal syllogism that at first sight seems quite close to that of Ibn Sīnā. In fact, Suhrawardī's modalities are to be understood as (...) the different ways a predicate relates to its subject rather than as propositional operators. Accordingly, necessarily necessary modality relates actual instances (presences) of the Subject-Term with actual (presences) of the Predicate-Term; in contrast, necessarily contingent modality relates these terms conditionally, notably involving states of the Subject-Term within time intervals. Suhrawardī's main innovation, so we claim, is the explicit dialectical role presences or actual instances have in his modal-temporal logic, and particularly so in shaping his notion of contingency that admits both a generic and an individual or de re form of plenitude. Recent work on the development of a dialogical approach to the logic of fiction stresses the notion of existence as choice. Moreover, this approach to existence has been combined with the notion of ontolog-ical dependence as deployed by A. Thomasson’s artifactual theory of fiction. In order to implement such a combination within the dialogical frame several predicates of ontological dependence have been de-fined. However, the definition of such predicates seems to lean on a model-theoretic semantics for mod-al logic after all. (...) The main aim of the present paper is to set a dialogical frame for the study of fictions in the context of the dialogical approach of CTT recently developed by S. Rahman and N. Clerbout where a fully-interpreted language is unfolded. We will herewith develop the idea that in such a setting fiction-al entities are understood as hypothetical objects, that is, objects (functions) the existence of which is dependent upon one or more hypotheses that restrict the scope of choices available. We will finish the paper by suggesting that this provides both a natural and genuinely dialogical way to understand R. Frigg’s take on scientific models as fictions and a new perspective on Thomasson’s notion of generic ontological dependence. The passionate and staunch defence of logic of the controversial thinker Ibn Ḥazm, Abū Muḥammad ʿAlī b. Aḥmad b. Saʿīd of Córdoba (384-456/994-1064), had lasting consequences in the Islamic world. Indeed, his book Facilitating the Understanding of the Rules of Logic and Introduction Thereto, with Common Expressions and Juristic Examples (Kitāb al-Taqrīb li-ḥadd al-manṭiq wa-l-mudkhal ilayhi bi-l-alfāẓ al-ʿāmmiyya wa-l-amthila al-fiqhiyya), composed in 1025-1029, was well known and discussed during and after his time; and it paved the way for the studies (...) of his compatriots Ibn Bājjah (d. 1138), Ibn Ṭufayl (1185), and Ibn Rushd (1198), who each gave demonstrative reasoning a privileged place within the methods of attaining knowledge. Unfortunately, as too often in the history of science, Ibn Ḥazm’s innovative perspectives and contributions in logic have been overlooked or considered with an attitude of contempt. On the one hand, his work has been seen, at best, as promulgating the benefits of studying Aristotle’s logic, so that his contribution is assessed as more didactical than conceptual. And on the other hand, those who do examine his innovations often consider them to be mistaken. As indicated by Chejne (1984, p. 2) contempt towards the logical work of Ibn Ḥazm was also present in its reception by the Eastern philosophers who accused him of deviating from Aristotelian logic and of dabbling in things beyond his capability. However, a reassessment of his work on logic has since begun, by delving into the ways the thinker of Córdoba studied the links between deontic and modal qualification of propositions. In this context Lameer’s (2013) paper on the logical sources of Ibn Ḥazm is worth mentioning; the author (p. 417, footnote 1) observes that, although, strictly speaking, it was al-Fārābī who first drew the parallelism between deontic and modal concepts, it was Ibn Ḥazm who developed it and worked it out in a more precise manner. A primary aim of this paper is to help fill some of these gaps by stressing the role of the work of Ibn Ḥazm in developing a notion of deontic necessity deeply rooted in legal normativity, and in explicitly discussing the transference between deontic and modal concepts. According to our view; the basic units of Islamic deontic logic are what we might call, indulging in terminological anachronism, heteronomous imperatives. As it turns out, the heteronomy of imperatives within Islamic legal systems contrasts with those of the purely moral realm, which seem to be closer to an autonomous conception of moral law. There it concurs again with Leibniz’s proposal to define obligatory as “what is necessary for a good person to do”. In the present paper, we will focus on the heteronomous imperatives of legal systems rather than on the imperatives of the purely moral realm. In this context, the work of Ibn Ḥazm extends the parallelism between the necessity of events and that of human actions stressed by his predecessors. According to our understanding, Ibn Ḥazm’s parallelism can be rendered explicit formally by means of a conditional (or hypothetical) structure shared by both deontic and modal propositions. Moreover, this structure makes apparent that this parallelism displays an underlying system of “degrees”. Indeed, while in the domain of events, given some conditions, it makes sense to distinguish between an event that is more likely to happen than another. Ibn Ḥazm speaks of near and distant possibility (such as the higher degree of likelihood of rain, given the condensation of clouds in December, and its lower degree, when the condensation occurs in summer); and, in the domain of actions, the Islamic notion of weighting actions determines degrees of virtue (or of legal and moral value). So whereas the degree of virtue of performing a forbidden act as determined by the distribution of sanction and reward is 0, we obtain the same value by pondering the likelihood of an impossible event to take place. Furthermore, as discussed in section II.3.2, the system of values at work in the parallelism can be seen as opening the way to a more direct correspondence. Thus, while in the realm of nature, likelihood of occurrence of an event is dependent upon the conditions specific to the occurrence of that event; while, in the realm of jurisprudence, likelihood of performing an action is dependent upon the distribution of reward and sanction specific to that action (being that, given the choice to perform or not perform a given action, those that will be rewarded are more likely to be performed than those that are not). According to this perspective, the point of the parallelism is that both deontic and modal qualifications measure the degree of an action or event to become actual; that is – indulging once more in anachronism (but this time from the Leibnizian background) – the degree measures how feasible (facile) an action or event may be. This suggests that Ibn Ḥazm’s perspectives already herald the links to probability and possibility explored by Leibniz six centuries later – see for example Leibniz’s (1671, A VI, I, p. 424-26) use of probability in the context of conditional right. Nevertheless, it also shows a crucial difference to the approach developed in the Elementa Jura Naturalis: whereas Leibniz’s studies seek to define what is to be just or virtuous, the logical system of deontic imperatives within Islamic jurisprudence presupposes that what is to be virtuous has already been settled. Determining what is to be virtuous is not achieved by logical reasoning within the system of legal jurisprudence, but by delving into the higher objectives of the Sharīʿa. While developing our point, we will delve into the logical structure of the heteronomous imperatives. This distinguishes our contribution from the existing literature, such as the papers of Chejne (1984), Lameer (2014), and Guerrero (1997, 2010, 2014), which do not provide a logical analysis of the deontic concepts put into work by Ibn Ḥazm. The true antecedent to the present paper is the work of Farid Zidani (2007, 2015), who, so far as we know, was the first to undertake such a task. Some of our own developments and general epistemological thoughts go beyond Ibn Ḥazm’s framework and motivations; mainly those contained in sections II.3.2 and IV. However, according to our view, these reflections suggest that Ibn Ḥazm’s approach has the substance for a broader and deeper exploration of the logic of norms. The paper is structured as follows:I.Ibn Ḥazm’s Logic of Heteronomous Imperatives. After presenting some extracts of the relevant text, we proceed by providing a formal reconstruction of the five forms of deontic modalities. II. A Landmark in the History of the Logical Analysis of Norms. Duties and Modalities. In this section, we study the transferences from deontic to modal necessity and possibility. We briefly compare the deontic system of Islamic Jurisprudence with that of Leibniz.III. Leibniz and Hypothetical Imperatives in Law.IV. Beyond Ibn Ḥazm: Conclusions and the Work Ahead. We will conclude the paper by discussing briefly some conceptual points that distinguish the logic of heteronomous imperatives from contemporary deontic logic. Our final words will discuss deontic-modal parallelism in the context of Ibn Ḥazm’s rejection of reasoning by conjecture and what we call “the internalization of nature.”. (shrink)

This study seeks to investigate the treatise of Abū al-Hasan b. Abd al-Rahman b. Muhammad al-Khatīb al-Shirbīnī al- Shāfiʻī (d. after 1028/1619) entitled Fatḥ al-Raḥīm al-Raḥmān fī tafsīr Āyat "inna Allāha yaʼmuru bi al-ʻadl wa al-iḥsān" based on the manuscript of the author. Shedding light on the translation of this unknown scholar, as it is evident from the title of the treatise that it contains the interpretation of this verse, which is well known among scholars and commentators as the most (...) comprehensive verse in the Qur’ān. In this tafsīr, Shirbīnī used many exegetical methods such as exegesis of the Qur'ān with the Qur'ān, exegesis of the Qur'ān with the Sunnah, exegesis of the Qur'ān with the sayings of the Companions, and al-tafsīr bi-al-raʼy, as well as tafsīr approaches such as linguistic tafsīr, the science of munāsabāt, and causality of nuzūl to analyze the meanings of the verse in depth. Another feature that increases the importance of this treatise is that al-Shirbīnī refers to the primary source tafsīr books together with their glosses, sometimes quoting from the commentators verbatim, and sometimes making meaning-based quotations from them, which is the most obvious indication of his exegetical ability and scholarly competence. In this work, he adopted a syncretic approach while emphasizing the meanings of the verse and followed an analytical-critical method while examining the subject. For this reason, he analyzed all the words in the verse one by one, dwelt on the meanings and interpretation of the words, and criticized their views after including the views of the commentators. Therefore, he applied the analytical exegesis method very successfully in this work. Accordingly, he analyzed the narrations related to tafsīr and mentioned the Companions' names during the narration. In particular, he analyzed the narrations from Ibn 'Abbas (d. 68/687-88) about the words al-ʻAdl and al-iḥsān, and stated that there was a dispute between the narrations about the phrase al-iḥsān. He took a scientific stance on the derivation of the word "Allah,” debated between those who accepted it and those who rejected it. He stated that the derivation of the word was not satisfactory and reliable. In the tafsīr of the words al-ʻAdl and al-iḥsān, he discussed the isnāds in Muqātil b. Sulayman’s (d.150/767) tafsīr emphasizing that he received the tafsīr of al-ʻAdl from Ibn 'Abbas and the tafsīr of al-iḥsān from 'Ali b. Abī Tālib. This approach is an important example for the isnād analyses of Muqātil b. Sulayman who was criticized for neglecting isnād chains in his tafsīr. He also criticized al-Baydāwī for being influenced by some of Zamakhsharī's sectarian and theological views. He classified the issue of kinship according to usūl, furū', and hawāshī, expanded the meaning of the verse, and insisted that the message of this verse encompasses all relatives, regardless of the degree of kinship. He was influenced by Latāʾif al-Ishārāt, al-Kashshāf, Mafātīhu al-ghayb, al-Baydawī, Hāshiya al-Jurjānī ala al-Kashshāf, and his grandfather al-Khatīb al-Shirbīnī’s (d.977/1570) al-Sirāj al-munīr. Qiyās, or “correlational inference” (often glossed as “analogy”), comprises a primary set of methodological tools recognized by a majority of premodern Sunnī jurists. Its elements, valid modes, and proper applications were the focus of continual argument and refinement. A particular area of debate was the methodology of determining or justifying the ʿilla: the legal cause (or occasioning factor, or ratio legis) giving rise to a ruling in God’s Law. This was most often discussed (and disputed) under the rubric of “the (...) modes of causal justification” (masālik al-taʿlīl). Among these modes was the much debated test of dawarān (concomitance of presumed cause and effect). In brief, proponents of dawarān employed it to justify claims that a property (waṣf) occasioned the ruling (ḥukm) in an authoritative source-case (aṣl). In concert with other considerations, the demonstrated co-presence (ṭard) and co-absence (ʿaks) of property and ruling—that is, their concomitance “in existence” (wujūdan) and “in nonexistence” (ʿadaman)— was taken as an indication that the property was the ruling’s ʿilla. Delving further into dawarān and causation (ʿilliyya), the current study interprets “in existence” and “in nonexistence” not as a kind of metaphor for true and false (within the framework of a classical truth-functional formal semantics), but as an accurate terminology vis-à-vis the meaning of causality statements, fully compatible with dominant Islamicate views on causal agency. In brief, a deeper logical and linguistic analysis of the different existential modes of dawarān strongly suggests that we should distinguish property (or phenomenon) and ruling (or effect) as types (concepts or propositions linguistically expressed by a sentence) as opposed to tokens (instantiations of the type; the real, ontological events that verify the proposition). Our reading of dawarān as shaped by a finer-grained structure not only allows us to identify the efficient occasioning process as a function which takes some particular token of the ʿilla (arguably, the property or properties which provide the ruling’s material cause) and renders a token of the general ruling type, but it allows us to elucidate the role of taʿlīl (causal justification) in shaping an epistemological theory of argument to the best explanation: a sophisticated, premodern manifestation of abductive reasoning. The main idea animating the present paper is that the general aim of debates, such as the one involving the notorious case of the Master Argument, is the ponderation of logical principles by confronting them with some set of assertions and other endorsed principles on the meaning explanation of connectives, quantifiers and modality. As suggested by Seel (2017), the point of the specific case of the MA is about examining Aristotle’s notion of possibility – as implemented by the Possibility Principle (...) (i.e., If it is necessary that if A then B, then B is possible if A is) and the Possibility Rule (i.e., If A is possible, and if B follows from the assumption of A, then B is is possible) in the context of a dialectical debate where it has been asserted that a given proposition is possible, even it is neither true now nor it will ever be, and where at the same time the irrevocability of the past has been endorsed. This suggests to study the MA debate in a setting based on Marion’s (2020) reconstruction of Aristotle’s Dialectical Bouts, adapted to propositions affected by modalities. The setting of Dialectical Bouts for the MA proposed includes•Propositions affected by Reichenbach’s (1948, § 5) three-folded temporal reference, namely: the point of speech S, the point of reference R and the point of the event E. This constitutes our take on Vuillemin’s (1977, 1979, 1984, 1996) suggestion of a “double indexation”.•The dialogical meaning explanation for modalities understood as involving hypotheticals. •The dialogical rules that settle the commitments undertaken when endorsing Aristotle’s Possibility Principle. In fact, in relation to the notion of possibility at work in Vuillemin’s (1996) reconstruction we explored different formulations of the Possibility Rule. Still, there remains a dearth of researches confronting the different formulations of the Possibility Rule with the texts studied by Crubellier (2010) and Rosen and Malink (2012). More generally and coming back to my remarks above, one of the most fruitful insights that can be gained from Vuillemin’s writings on the MA, is that such kind of debates provide an instance of a general pattern for reasoning that I shall call Dialectical Bouts of Material Admissibility (BMA). The rationale behind such kind of argumentation-pattern is to examine the incorporation of new (epistemological, ontological or logical) principles against the background of the commitments undertaken by endorsing a specific set of assertions and meaning explanations. They display the kind of abductive procedure stressed by Crubellier’s (2014) study of syllogism. Under this perspective Ebbinghaus’s (1964) casting of the inferential moves that reduce imperfect syllogisms to perfect ones as implementing an admissibility procedure, represents a logical generalization of the material procedures at stake in the Dialectical Bouts of Material Admissibility. Furthermore if, as stressed by Duthil-Novaes (2005) Medieval Obligations represent a development of Aristotelian Bouts aimed at the ludic exercise of consistency maintenance, DMA should be rather linked to the Islamic tradition of dialectical theory [jadal, munāẓara, ādāb al-baḥth], aimed at the epistemological task of what Young (2017) calls the forging of principles, including legal and deontic ones. In a more contemporary setting, DMA can be related to Brandom’s (2000, pp. 66-77) considerations on Non-Conservative Extensions, where the point of dialectical procedures is put under public Socratic scrutiny the discovery and elucidation of concepts. This general point on Dialectical Bouts of Material Admissibility can be seen as underlying Vuillemin’s project of linking the study of the MA with the classification of philosophical systems.The present paper does not contain a fully developed study on such Dialectical Bouts, but it is rather is an invitation to pick up the gauntlet that Jules Vuillemin threw into the ring. Ahora bien, se supone que la lógica linear es el instrumento más apropiado para describir procesos computacionales de deducción. Irónicamente, las semánticas formales usuales, que podrían utilizarse para una (...) fundamentación representacional de la lógica linear han sido hasta ahora más bien infructuosas. Es más, parece que la semántica de la lógica linear es esencialmente pragmática y basada en una estructura dialógica. Objetivo de este trabajo es discutir una nueva semántica para la lógica linear que destaca precisamente los fundamentos pragmáticos de tales aspectos dialógicos entendidos como una controversia argumentativa, a saber, contexto de argumentación, relevancia e intercambio de información. Rapid development in the area of assisted reproductive technology, has benefited mankind by addressing reproductive problems. However, the emergence of new technologies and techniques raises various issues and discussions among physicians and the masses, especially on issues related to bioethics. Apart from solutions provided using conventional bioethics framework, solutions can also be derived via a complementary framework of bioethics based on the Higher Objectives of the Divine Law in tackling these problems. This approach in the Islamic World has been applied (...) and localised in the Malaysian context. Thus, this paper highlights a conceptual theoretical framework for solving current bioethical issues, with a special focus on ART in the Malaysian context, and compares this theory with conventional theories of bioethics. Around the 1960's, C. Perelman / L. Olbrechts–Tyteca and S. Toulmin endorsed the separation between argumentation and logic. In fact, both assumed a gap between everyday reasoning, closer to legal reasoning, and scientific reasoning based on mathematics. The main claim was that both paradigms are incommensurable, since the legal paradigm makes use of the notion of formality, that has a procedural nature with roots on a conversational and dialectical practice, and logic is based on the notion of form, that involves (...) static (and syntactic) features. I will contest the incommensurability of both paradigms, as J. van Benthem (2009) did already, and plea that what we need is more rather than less logic. There are no juridical solutions to logical problems, if the problem is related to reasoning, then the solution relates to inferences drawn on the basis of juridical knowledge. (shrink)

Tri-parent baby technology is an assisted reproductive treatment which aims to minimize or eliminate maternal inheritance of mutated mitochondrial DNA. The technology became popular following the move by the United Kingdom in granting license to a group of researchers from the Newcastle Fertility Centre, Newcastle University to conduct research on the symptoms of defective mtDNA. This technology differs from other assisted reproductive technology because it involves the use of gamete components retrieved from three different individuals. Indirectly, it affects the preservation (...) of lineage which is important from an Islamic point of view. This paper aims to analyze and discuss the implications of the tri-parent technology on preservation of lineage from the perspective of Maqasid al-Shari’ah based the Islamic bioethics. The analysis shows that there are a few violations of the preservation of lineage, hence the tri-parent baby technology should not be permitted. (shrink)

The existence of ‘human-like’ attributes and actions in the Qur’an and Hebrew Bible entails to various interpretations towards anthropomorphic verses among the Muslim and Jewish counterparts. Al-Ghazali and Maimonides in their discourses strongly affirmed the unity of God and refuted anthropomorphism. Therefore, this study expounded al-Ghazali and Maimonides’ methods in affirming the incorporeality of God through outlining the similarities and differences in their interpretation. This study was qualitative in nature which analyses writings of al-Ghazali and Maimonides in encountering anthropomorphism. It (...) can be deduced that both scholars were found to be employing allegorical interpretation with different level of interpretations in their attempts to repudiate the corporeal form of God. Alternatively, they both agree on the literalist’s approach with conditions that one must not perceive God’s essence in a bodily figure. Consequently, believing so will lead one to heresy. In sum, their emphasis on an incorporeal God brought them to similar interpretation despite their different religion and theological or philosophical orientation.Contribution: This article contributed to comparative theological study in understanding anthropomorphic verses through the discourse of al-Ghazali and Maimonides in Islam and Judaism, respectively. ‘Abdallāh b. ‘Abd al-Rahmān al-Nāṣir the son of ‘Abd al-Rahmān III is one of the figures who have remained unnoticed both in classical sources and in contemporary studies. Among the main objectives of this research are to compile and collect information about his life, about whom most of the historical sources of al-Andalus give little or no information. According to historical sources, ‘Abdallāh b. ‘Abd al-Rahmān opposed the appointment of his brother al-Hakam II as the heir apparent and was alleged (...) to have masterminded a coup d'état together with some prominent Shāfiʿi scholars of the time, therefore he was arrested at a date close to the Eid al-Adha of 338/950 or 339/951, and then was executed by his very father. However, was this short and seemingly biased narrative really a preparation for a coup d'état or a conspiracy against ‘Abdallāh and his proponents? Why did ‘Abd al-Rahmān not hesitate to make such a sad decision about his own son? So, within the framework of these and similar questions, to reveal the details of the event of ‘Abd al-Rahmān's disappearance by his father and the psychosocial reasons behind it in the light of the current data are among the aims of the research. Muhammad Arsyad Al-Banjari who lived from 1710 to 1812 in Borneo, Indonesia, applied a model of integrating uses of the Banjarese tradition into Islamic Jurisprudence based on a dialectical constitution of qiyās, the legal argumentation theory for parallel reasoning and analogy, he learned from the Shāfi‘ī-school of jurisprudence (uṣūl al-fiqh). Our paper focuses in the model of integration proposed and practiced by Al-Banjari, a rational debate grounded on a dynamic view on legal systems. We will illustrate the method with the (...) help of two different kinds of qiyās deployed by Al-Banjari in order to argue for the rejection of some traditional Banjarese offering-rituals for avoiding disease or calamities (manyanggar and mambuang pasilih), and for the acceptance of the use of consuming the traditional drink called lahang made of the juice of sugar-palm. As our dialogical reconstruction shows, the development of the debates, particularly the first one, is quite sophisticated, with a Banjarese opponent that does not surrender easily to the rejection of his use of those rituals.
